CSUS / inquire about the current employment status of Barbara O’Connor

Dear Madam/Sir:

This will serve to verify and inquire about the current employment status of Barbara O’Connor with respect to California State University, Sacramento.

Specifically, is she presently a professor with the university? My initial research leads me to believe that she is no longer affiliated with CSUS, even though she is listed elsewhere as a current professor (ie, CETF website. See: http://www.cetfund.org/aboutus/board/OConnor-Barbara ).

For that reason, I would like for you to verify this matter by providing me with the exact dates of her employment.

Dr. O’Connor is a nationally recognized expert in the fields of political communication and telecommunications policy and applications. She is the author of numerous publications in both of these areas.

Her numerous appointments, boards and chairs, include the: California Educational Technology Committee; Washington, DC based Alliance for Public Technology; Alliance; California Public Broadcasting Commission; Network Reliability and Interoperability Council; Bellcore’s Advisory Board; ATT’s Consumer Advisory Panel; Verizon’s Consumer Collaborative Council; ETS international ICT literacy effort; National ICT Policy Council; and California Educational Technology Industry Task Force. Dr. O’Connor is an expert consultant and has served a wide array of business, media, telecommunications, federal and state clients and task forces.

Awards and honors include: an by 1990 California State University outstanding teaching award; 1994 California State University Alumni Distinguished Professor Award; 1996 Technology Leadership award; 1998 Technology Pioneer Award.

Recent research grants and projects, include: Ten California Public Utilities Commission Telecommunications Graduate Fellowships; and the Sacramento County Communications Audit and Web Portal development project.

Dr. O’Connor received her Ph.D. in Communications from the University of Southern California in 1974. She was featured in Newsweek’s 1995 “50 for the Future” a feature on the fifty people who will set policy and direction for global communications.

Dr. O’Connor has always blended her teaching, research and community service into a consistent commitment to explain the role of media in society and its impact on citizens, institutions and the democratic process and continues to teach a full load.

LA TIMES: Orange County judge Scott Steiner investigated on suspicion of improper sexual conduct

An Orange County Superior Court judge is being investigated by the Sheriff’s Department on suspicion of  improper sexual conduct — allegedly in his courtroom chambers – authorities said.

Deputies are completing a month-long investigation into Scott Steiner, a former high-ranking prosecutor and the son of former Orange County Supervisor William Steiner, said Jim Amormino, a spokesman with the sheriff’s department.

Amormino said that Steiner’s chambers were searched, and potential evidence was gathered and will be tested for DNA.

The investigation is expected to be completed next week, and deputies will send a report to the state attorney general, Amormino said.

“We’re looking into all the allegations to see if they’re criminal or not,” Amormino said.

Steiner, a prosecutor in the county for more than a decade, was elected to a six-year term on the bench in 2010.

The district attorney’s office was informed last month that Chapman University, where Steiner teaches, was conducting an inquiry into Steiner’s conduct, said Susan Kang Schroeder, the district attorney’s chief of staff.

“The Community Collaborative Fund ensures that California’s traditionally underserved communities will benefit from the sweeping changes we are seeing in the telecommunications industry,” said Verizon Pacific Region president Tim McCallion. “With this fund, Verizon is demonstrating its long-term commitment to Californians — a commitment that will live on beyond the life of the fund.”

Verizon has presented the first installment of $2.5 million to the California Consumer Protection Foundation (CCPF), which will serve as the fund’s administrator. CCPF will direct the money to programs throughout the state that provide access to telecommunications and information services, education and telemedicine, and that promote literacy and economic development in low-income, ethnic, minority, limited-English-speaking, and disabled communities.

Verizon will contribute the remainder of the $25 million in annual installments of $2.5 million through 2010. In addition to the Community Collaborative Fund, Verizon has made commitments to provide almost $30 million to philanthropic causes in California over the next decade. APA Spotlight is a weekly interview of Asian Pacific Islander Americans (APIA) community leaders. It is a spotlight on individuals who have dedicated their careers to issues surrounding the APIA community with the goal of bringing much deserved recognition to their work and cause(s).

Stewart Kwoh is the President and Executive Director of the Asian Pacific American Legal Center of Southern California (APALC). Under Kwoh’s leadership, the APALC has become the largest and most diverse legal assistance and civil rights organization targeting Asian Pacific American in the United States. He is also Vice-Chair of the Board of Directors for the Asian American Justice Center (AAJC), which was co-founded by APALC in 1991. AAJC is the country’s first national pan Asian civil rights organization.

Stewart Kwoh earned his Bachelor of Arts at UCLA and his Juris Doctorate degree from the UCLA Law School. He was a grader for the California State Bar Exam and has been President of the Southern California Chinese Lawyers Association. He is also an instructor at UCLA for “Asian Americans and the Law.”

Having grown up in Los Angeles, Stewart Kwoh has actively pursued interests in a wide range of community issues. He is a board member of numerous community organizations. He has been a steering committee member of the Coalition for Humane Immigration Rights of Los Angeles (CHIRLA), and President of the UCLA Asian Pacific Alumni Association. He served as an appointed board member of the city of Los Angeles Charter Reform Commission. Stewart Kwoh has been a board member of the El Pueblo Historical Monument Authority Commissioners, which governs the area known as the birthplace of Los Angeles. He was also on the executive committee of the Asian Pacific Policy and Planning council, which is a coalition of 50 human service programs.

Stewart is very active with foundations, other philanthropic organizations, and nonprofit organization. He has been Chair of the Board of Directors (2000-2002) of The California Endowment, which is the largest health foundation in California. He is one of the first Asian Americans to chair the board of a large foundation in the U.S. He is a trustee of the Methodist Urban Foundation, California Consumer Protection Foundation, The California Endowment, The California Wellness Foundation, The Tang Family Foundation, and The Fannie Mae Foundation. He serves on the board of the United Way of Greater Los Angeles. Stewart serves on the boards of a public television station, KCET, and a public radio station, SCPR. Stewart also serves as chair of the 1010 Development Corporation which is a faith based nonprofit that has built affordable housing for low-income seniors and families. He is also involved in several educational reform organizations and is an active member of several corporate advisory panels.

After the Civil unrest in Los Angeles in 1992, Stewart Kwoh helped to initiate the Multicultural Collaborative, a committee of 11 minority organizations dedicated to develop a comprehensive plan for human relations improvement in Los Angeles. He also assisted the development of the joint dispute resolution program between the Martin Luther King Dispute Resolution Center and the Asian Pacific American Dispute Resolution Center, a program that aimed to resolve interethnic conflicts by teaming African American, Korean American and other mediators. Finally, the Asian Pacific American Legal Center has partnered with the Southern Christian Leadership Conference and the Central American Resource Center to develop the Leadership Development in Interethnic Relations (LDIR) program that has trained hundreds of participants in skills to improve human relations. The core of the program is a six month voluntary training and work experience format that brings 30 participants together at one time to go through the course and project.

Due to his extensive involvement, Stewart Kwoh has received Lawyer of the Year recognition by the California Lawyer magazine in 1998, and was named one of the top 100 most influential Asian Americans of the decade by A magazine in 1999. He has been recognized for his passion for justice by the California Community foundation and the Liberty Hill Foundation. He has been a recipient of various awards including: Mayor’s Award, L.A. City Human Relations Commission, 1996; Honorary Doctor of Law Degree at Williams College in 1996; President’s Award from the Southern Christian Leadership Conference of Greater L.A. and Martin Luther King Legacy Association (King Week Festival) in 1994; Faith and Freedom Award from the University Religious Conference at UCLA in 1993; CORO Public Affairs Award in 1993; Asian Pacific Heritage Month Award in 1993; ACLU Award in 1993; Professional Award from the L.A. County Human Relations Commission in 1992; and “The Individual” Award from the Public Counsel in 1991.

The mission of Asian Pacific American Legal Center of Southern California is to advocate for civil rights, provide legal services and education and build coalitions to positively influence and impact Asian Pacific Americans and to create a more equitable and harmonious society.

What is the mission statement of your life?

My mission is to help achieve justice for all Americans, particularly people of color and Asian American and Pacific Islanders. I believe the United States should to live up to its ideals and principals.

How did you end up doing what you’re doing?

My parents were very community-minded Christians. My mother was an activist in entertainment, and founded East West Players in the basement of her church. My father also was very involved with the church.

I also was influenced by the civil rights movement and the fight for freedom by African Americans, Latinos and Asian Americans. A particular moment that stood out for me was when I was an undergraduate at UCLA. I was president of the Asian American Student Alliance when the U.S. troops invaded Cambodia in 1970. There were protests at UCLA, I helped bail some protesters out of jail. That was a transformative moment for me. I decided to apply for law school instead of medical school.

If you had a crystal ball, what do you see for the future of the Asian Pacific Islander American community?

I see a community that will continue to grow in both population and political activism. About 15.5 percent of California’s population consists of Asian Americans and Pacific Islanders. Nationally, we are at 5 percent.

The future of our community will depend on our ability to become more active and engaged AAPIs and to connect with other racial and ethnic groups. But we will still be confronted with discrimination. One wildcard will be what happens to U.S. and China relations, and how that will affect how all AAPIs are treated.

Bonus Question: What advice do you have for young professionals?

I’d say to them, ‘Follow your passion. Get involved in community groups.’ Hopefully they will become passionate about volunteering in their community.

Bonus Question: What are your comfort foods and what memories do you have associated with them?

I remember when I was young, my mother used to cook beef roast. It is still my favorite comfort food.

Bonus Question: What’s your guilty pleasure?

If I could, I wish fish every day. But my wife only allows me to keep a certain amount of fish in the freezer.

Debbie Schlussel: Starbucks Jihad — Iranian Chick Poisons San Jose Starbucks Drinks with Lethal Mix

Ramineh Behbehanian, a Johnson & Johnson pharmacist of Iranian descent, decided to fill some orange juice bottles with lethal doses of rubbing alcohol and put them on the Starbucks shelves. But, hey, I’m sure the fact that she’s Iranian had nothin’ to do with it, right? Can’t possibly be jihad . . . if you’re in fantasyland. Police have predictably already uttered the usual “no motive surfaced” BS line. When someone from Iran poisons orange juice at Starbucks, trying to murder random Americans and hurt the business of pro-Israel Jew/Starbucks CEO Howard Schultz (whom Muslims are boycotting for speaking out against anti-Semitism and supporting Israel), I’m sure all those crescent-aligned facts are “just a coinkydink.” Gotta be. (Not the first time, by the way, that Starbucks has been targeted by some sort of extremists.) Oh, and you might wanna check your Johnson & Johnson meds. Just sayin’. I’m sure we’ll also be told more of the usual: that she’s just mentally disturbed or something.

There are more unanswered questions about Danny, an alleged car jacking victim.

When one speaks the truth, there is one story, when one is lying, he comes up with different stories.

Originally story of the carjacking victim was that Tzarnaevs simply let him go and they bragged to him about being the bombers. I wrote an article stating that the whole story does not make sense. why would people, who had no qualms about murdering little children in the crown simply let this man go, so he would call the police. Why would they carjack his car to escape and just brag about being the bombers.

After I wrote the article suddenly a new account appeared. according to the new account while the older Tzarnaev went to the gas station and the younger was filling the gasoline, the victim escaped.

Next day a third version appeared, where the victim escaped when Tzarnaev got distracted with the GPS. What is interesting that according to the new version Tzarnaevs didn’t really brag about the bombing, but they spoke between them in Russian and the man understood what they said.

Another interesting detail is that this man is Chinese.

Here is my question: how many Chinese man do you know, who speak fluent Russian? Keep in mind, this is not like someone Portuguese understanding Spanish, which is a similar language. Russian and Chinese are completely different languages.

So, did the police ask this carjacking victim Danny: why are you telling us three different stories, what is going on here?

Dis the police ask him: how do you know Russian? Did you go to Russia, did you live there? Did you live in Chechnya? did you live in Dagestan?

Also, keep in mind that Dagestan and Chechnya is very close to Asian republics where people look oriental. In Chechnya and Dagestan the population looks middle Eastern, and they look like they are Persian or Turkish or Syrians. In Kazakhstan, Turkmenistan, Kirghistan, Turkmenistan and Uzbekistan population looks oriental. These are descendants of Tatars and Mongols and they look like Chinese. Id this man , Danny, Chinese or is he someone who came from one of those former Soviet Republics.

If he is Chinese, ask him, where did he study Russian?

Steve Li was living up to his – and his parents’ – American dream until his untold past caught up to him.

The 20-year-old City College of San Francisco student was chasing his goal to open a medical clinic serving the immigrant community, when U.S. Immigration and Customs Enforcement officials knocked on the door of his Ingleside apartment more than a month and a half ago.

Now he faces deportation to a country where he has no friends or family. While experts say his situation is not unusual, his case now has the support of thousands.

“One day I was getting ready to go to school to see my friends and teachers, and the next day I was locked in jail with criminals and gangsters and being treated like I wasn’t a person,” he said during a telephone interview from a detention center in Florence, Ariz.

Li, whose legal name is Shing Ma Li, was born in Peru but always thought he was in the United States legally because his tourist visa has a 2012 expiration date.

What his mother, Li Maria Ma, 50, never told him was that the tourist visas his family was granted in 2002 didn’t mean they could stay for 10 years.

Sen. Jerry Hill, D-San Mateo: Michael Peevey, California Public Utilities Commission president, a ‘dictator’

State Sen. Jerry Hill, D-San Mateo, has challenged both Pacific Gas and Electric and the agency that governs it, the California Public Utilities Commission, to step up and make the state’s gas delivery system safer after the San Bruno pipeline explosion and fire that killed eight in 2010.

Over the years, Hill has crafted legislation to make both PG&E and the CPUC more accountable to the public while also safeguarding it.

But numerous reports, especially an internal “Safety Culture” document released last week, indicates that the CPUC has placed less importance on safety than it should have.

Now, Hill has a new challenge for the CPUC — have your president sit down with lawmakers this Thursday to answer questions related to fiscal responsibility and safety issues.

The CPUC president is Michael Peevey, appointed to the post more than 10 years ago by then governor Gray Davis.

Hill calls Peevey a “dictator” who can only be ousted from his job by Gov. Jerry Brown or a two-thirds vote in the Legislature.

“It would be nice to be able to question him,” Hill told the Daily Journal yesterday.

Hill invited Peevey to testify at the Senate Budget and Fiscal Review Subcommittee this Thursday.

“All concur that there is a problem at CPUC. It appears to be out of control,” Hill said about National Transportation Safety Board, Legislative Analyst’s Office and internal CPUC reports.

The confidential internal CPUC report released last week quoted numerous employees of the organization who said safety was not a priority or that the commission did not want to levy fines for safety violations against utilities such as PG&E.

“If we were enforcing the rules, we would not have to worry about a safety culture. If we were holding the utilities accountable and doing what we were supposed to be doing, San Bruno would never have happened,” one employee was quoted as saying in the “Safety Culture” document.

Hundreds of millions of dollars were also misallocated by the CPUC, Hill contends.

CPUC president Michael Peevey answers questions from the Investigative Unit after snubbing lawmakers for a conference in wine country

The embattled president of the California Public Utilities Commission recently ignored the call to answer tough questions by state senators in Sacramento and instead decided to attend a conference at an exclusive Napa resort and a reception at an upscale winery in St. Helena, both of which were captured on hidden camera by the NBC Bay Area Investigative Unit.

Michael Peevey was asked to appear before the Senate Budget and Fiscal Review subcommittee on April 25 to justify keeping the job he has held for the past decade. The senate hearing was in response to growing conflict over a confidential report, uncovered by the Investigative Unit, which raises questions about the CPUC’s commitment to safety and its relationship with utility companies the agency regulates.

“The governor needs to replace the president of the Public Utilities Commission,” Sen. Jerry Hill said in an interview with NBC Bay Area last month. “The current president has been there for many years and he has had a very cozy relationship with the utilities, which this report indicates.”

Hill’s call for change at the CPUC was recently echoed by two lawmakers.

“I think the question is, who should be leading this organization so the people of California are safe,” San Jose assemblywoman Nora Campos said at a recent legislative hearing.

At that same hearing Los Altos assemblyman Richard Gordon added, “I have come to the point where we need serious change in the leadership of the PUC to bring change.”

After calling for his job two weeks ago, Hill wrote Peevey a letter formally requesting his presence at the subcommittee hearing. The letter states, “For all the shortcomings under your leadership at the CPUC over the last ten years as documented by independent reports… it’s critical that you testify…to justify your continued appointment as the president of the California Public Utilities Commission.”

Instead of addressing the conflict, Peevey kept a prior engagement at the Silverado Resort and Spa in the heart of Napa. According to the agenda, the conference was about clean energy, and Peevey was scheduled to give a short five to seven minute presentation for the non-profit organization, California Foundation for the Environment and the Economy (CFEE).

Before the conference started, at around 11 a.m.—the same time he was expected in Sacramento—NBC Bay Area’s hidden cameras spotted Peevey mingling with guests in the resort conference center. The day officially started at noon, with a catered lunch after invited guests such as a representative from Pacific Gas & Electric and, somewhat ironically, more than two dozen Sacramento lawmakers, checked in at the event. Peevey gave his presentation at 1:30 p.m.—two and a half hours after he was scheduled to speak in Sacramento.

After four hours of conference sessions Peevey boarded a luxury bus and drove through the Napa Valley to the next event on the agenda—a reception and dinner at St. Helena’s exclusive Merryvalewinery. For more than three hours, Peevey ended his day inside the facility along with more than 100 guests.

Following the reception, NBC Bay Area’s Chief Investigative Reporter Tony Kovaleski met Peevey outside the winery to ask questions about his priorities, and the confidential report. Below is a transcript of a part of the conversation:

Tony Kovaleski: You were asked to speak to senators today about the safety of your PUC. Instead you spent your day here in Napa.

Michael Peevey: No, that’s not true.

Kovaleski: What is the message you sent by coming here to Napa instead of going to speak to the senate?

Peevey: You are very antagonistic you know. You are reading a script.

Kovaleski: Sir, I am not reading a script. I want to give you an opportunity to respond.

Peevey: But your questions are the wrong questions.

Kovaleski: You spent time here with the utilities you are paid to regulate.

Peevey: There’s no utilities here that I know of.

Kovaleski: PG&E was here. We saw them on the list.

Peevey: Oh, there may have been one person, I don’t know.

Kovaleski: That report said your agency is too cozy with utilities. Is that true?

Peevey: No. Stop. That’s one person who said that. That’s not what the report said. There was no conclusion in the report. It was an interview with various individual employees of the Public Utilities Commission.

Kovaleski: Sir, you have been asked by lawmakers to step down. Lawmakers have said you should be fired. Should you be fired, sir?

Man with Peevey: No, he shouldn’t be fired. They don’t have the authority.

(Peevey starts to walk away).

Peevey: You poor son of a b****. You have a job to do. It’s pathetic what you are doing. It’s pathetic.

(Peevey gets into a car).

Kovaleski: Sir, should you answer to lawmakers when they ask to speak with you? What’s the message you sent tonight by coming here?

(Car drives away).

NBC Bay Area asked to speak with Peevey about the confidential report prior to the conference in Napa, but did not receive a response to that request from the CPUC. The CPUC did provide a written statement about the report:

The CPUC has made safety an underlying principle in all its actions. As we work to instill a corporate culture in our regulated utilities that embraces safety as a tool and an enhancement to their mission, we must ensure we do the same at the CPUC. We have hired consultants to help us in our process of culture change across all the industries we regulate. As part of these efforts, our consultants conducted an informal survey of internal employees to see what they think safety means, how they see their role in safety, and how they think we can do better as an agency. The report is the result of the informal survey; it is not an analysis of our safety culture or conclusions by our consultants, but a reporting-back of what some employees said in informal focus groups. As the report says, “This report is not an evaluation of the objective truth of those views and perceptions.” We will use the results of the report to help us define what we need to change, develop strategies and actions to implement the changes, and ensure accountability as the process continues.

This is not the first time Peevey has snubbed lawmakers for an all-expense paid event. He was asked to speak at an assembly committee meeting in 2011, but reports indicate he accepted a free trip to Sweden that was funded by the Swedish government and the California nonprofit, The Energy Coalition. When asked by reporters in April about his confidence in the leadership of the CPUC, Gov. Jerry Brown said Peevey is “well-experienced.”

“He’s flawed like everyone else in this building,” Brown said, “but he has a lot of knowledge and he has great commitment.”

Who Are We?

In May 1988, the California Public Utilities Commission (CPUC) issued General Order 156 (GO 156). Under GO 156, the CPUC required all investor-owned electric, gas, water and telecommunication utility companies with gross annual revenues in excess of $25 million and their regulated subsidiaries and affiliates, to develop and implement programs to increase the utilization of WMBES. Procurement goals of 5% for women and 15% for minorities were initially established, and later expanded to include a goal of 1.5% for service-disabled veterans.

Certification of eligible suppliers was designed to encourage, recruit, and utilize WMBEs by participating utilities.

The Clearinghouse is a Commission-supervised entity whose primary purpose is to audit and verify the status of WMBEs, and to establish and maintain a database of WMDVBEs that is accessible to the CPUC and to participating utilities. The Clearinghouse audit and verification program precludes the need for individual utilities to audit and verify WMBEs with whom they do business.

Adding fuel to the fire is the recent discovery that CSCHS — while headed by the embattled Ronald George — seeks financial donations, some of which it later forwarded to an entity known as the Institute of Governmental Studies (“IGS”), where Eric George (son of Ronald George) serves as a director.  Previously, a RICO suit alleged that Ronald George unlawfully transferred funds from entities that were under his control (such as the California Administrative Office of the Courts (“AOC”) intended for the CCMS computer system) into various accounts that were specifically maintained in Alan Rothenberg’s bank — 1st Century,  a bank which Eric George owns in part. Said funds, as the suit alleged, were later embezzled.  As part of maintaining the scheme, the suit alleges, AOC employees Ronald Overholt and William Vickery were bestowed with various gifts, trips, kickbacks, bribes, excessive salaries, and the like. Similarly, and also as part of guarding the scheme, the suit alleges that defendants, at times, resorted to utilizing the services of Tom Layton — a former Los Angeles Deputy Sheriff/Senior State Bar of California investigator — to “illegally gather detrimental dirt” on various individuals who would oppose and/or object to the existence of said arrangements.  According to sources, Tom Layton is part of an ongoing “ambulance chasing” scheme that the Girardi Syndicate operates in San Bernardino County vis-a-vis a satellite office located in San Bernardino and managed by Thomas Girardi’s son-in-law, David Lira.

President Barack Obama rewarded one of his most prolific fundraisers Thursday, announcing his nomination of Hyatt heiress Penny Pritzker to become the secretary of commerce.

“Penny understands that just as great companies strengthen the communities around them, strong communities of skilled workers also help companies thrive,” Obama said Thursday.

Pritzker is the chairman and chief executive officer of PSP Capital Partners, an investment firm, and its affiliate, Pritzker Reality Group. She has an estimated personal wealth of $1.85 billion.

Pritzker chaired the president’s 2008 finance team and delivered a haul of more than $1.3 million for Obama’s two campaigns, according to Open Secrets. A long-time Obama champion, Pritzker donated $13,000 to Obama’s campaigns prior to his presidential efforts. Pritzker also personally wrote a $250,000 check for the president’s inauguration this year.

The nomination is not a surprise. Pritzker was considered for the position in 2008, and resigned her position on the Chicago Board of Education last month, fueling increased speculation she would be Obama’s commerce pick.

Notably, Pritzker has had a number of flare-ups with unions last year, and in the past, told Obama in 2009 that she opposed legislation for union-backed card check.

Despite a less prominent campaign role in 2012, Pritzker served as a co-chair of the president’s campaign and flew on Air Force One last summer–the same day the largest national hospitality workers union announced a global boycott of Hyatt Hotels.

Geoffrey Brown and Michael Peevey were involved in a CPUC Fundraiser, asking for donations from the Utilities they regulate, at a cost of $20,000 per table. This was in January 2011, which was a few months after the PG&E fire in San Bruno.

Geoffrey Brown was one of the Officers of the Fundraiser I can’t find the link, but I recall that Geoffrey Brown was the number 2 officer of the Fundraiser, and Peevey was the number 1 Officer of the Fundraiser. It was because of this fundraiser, that I learned of Geoffrey Brown’s relationship to Peevey’s Chief of Staff.

Assemblyman Jerry Hill gave another verbal lashing to the CPUC today for an event held in the commission’s honor that solicited money from the utilities it regulates.

PG&E was among several utilities, along with other organizations, that bought $20,000 tables for a dinner in San Francisco that celebrated the California Public Utilities Commission’s 100th anniversary.

Hill, D-San Mateo, blasted the utility’s involvement in the fundraiser because, he said, the money raised by the foundation—which is a separate entity from the commission but has former regulators on its board—could be used to potentially influence the CPUC’s decisions with financial support coming from companies such as Pacific Gas & Electric Co.

“One hundred years of the California Public Utilities Commission is a tremendous accomplishment and they’ve done great work over the years,” Hill said as he stood in front of the steps of the CPUC’s headquarters. “But this dinner has been hijacked into a fundraising event for this foundation, and that’s the problem I have with it.”

Hill has become increasingly critical of the CPUC since numerous problems have been revealed about PG&E’s pipeline safety practices following the Sept. 9 gas explosion and fire, which left eight people dead and 38 homes destroyed.

The CPUC foundation was established to educate the public about the work the commission performs, and the money raised at today’s fundraiser would be used to award staff members, pay for training and put on public forums.

Hill said today’s event sends the message that the CPUC’s focus isn’t where it should be: investigating the cause of the explosion and properly auditing utility inspection records.

“If you’re going on a trip to a conference some place, staying in a hotel and going to the classes, and that is paid for directly by the utilities that you regulate,” Hill said, “how can you have an arm’s length relationship with that utility?”

Thomas MacBride, a lawyer who sits on the foundation’s board, disagreed with Hill’s take on the event and said the foundation was established with the intent of promoting the history of the CPUC, not influencing legislation. Most of the events the foundation is expecting to organize, he added, won’t even be related to issues over which the CPUC has jurisdiction.

In defense of PG&E’s involvement in the fundraiser, MacBride said PG&E was among more than 30 organizations that donated money to the event—all of which have been involved with the CPUC in some capacity, including consumer advocacy group The Utility Reform Network.

“It’s a big deal because it’s the agency’s founding,” he said.

San Bruno residents John and Joanne McGlothlin, whose Claremont Avenue home was damaged in the Crestmoor fire, were the only members of the public besides reporters who showed up at Hill’s press conference.

John McGlothlin said they showed up to support Hill’s comments toward the CPUC, adding that he has now lost faith in the commission since the explosion.

“My issue is that I’ve been hearing about how they regulate since the fire, and it has changed my perception,” McGlothlin said. “I think there was an attitude of ‘Go easy, don’t clamp down and don’t fine them,’ because (the utilities) won’t report things.”

Also on today, CPUC President Michael Peevey announced that he would make the commission’s investigation of the Crestmoor explosion more open to the public, according to media reports.

The National Transportation Safety Board is leading the main investigation into the pipeline explosion, which could take more than a year. Shortly after the disaster, the CPUC also decided to set up its own independent panel to look into the explosion, but the decision to make the investigation’s proceedings more available to the public only came after the commission began hearing complaints that the investigation was being conducting behind closed doors.

The New York Times calls Sen. Rand Paul (Ky.) one of the Republican Party’s “rising stars.” The Daily Beast says he’s “a smoother, more pragmatic political operator” than his father, former congressman and presidential candidate Ron Paul (R-Tex.). All that seems true. So riddle me this: What’s the upside for Paul to put his name on e-mails like this one, which landed in my inbox this morning?

It’s one thing for no-name pols to work on the fringes. But Paul, at this point, has a lot to lose. Yet here he is, suggesting the current president of the United States is working with “anti-American globalists plot[ting] against our Constitution.” And for what?

“The lawyer who has been defending controversial plaintiffs attorney Steven Donziger in a lawsuit by Chevron Corp (CVX.N), filed a motion on Friday to withdraw as counsel, citing Donziger’s inability to pay his legal bills,” according to Reuters

With their clients unable to afford fighting claims that they fraudulently snared a $19 billion judgment against Chevron in Ecuador, two law firms now seek to withdraw. “This is an extraordinary case, which has degenerated into a Dickensian farce,” John Keker of the San Francisco-based firm Keker & Van Nest wrote in a 15-page motion, according to Courthouse News Service.

As expected, in a highly miselading press-release, Donziger blamed Judge Lewis Kaplan and Chevron (rather than his own inability to pay).  Donziger  wrote:

NEW YORK, May 03 /CSRwire/ – Citing the bias of New York federal judge Lewis A. Kaplan against Ecuadorian rainforest residents who won a judgment against Chevron, a prominent law firm is seeking to withdraw from its representation of New York attorney Steven Donziger in a related New York case that it says “has degenerated into a Dickensian farce” due to the oil giant’s abusive litigation tactics.

Keker & Van Nest, which represents Donziger, who is the main target of a Chevron retaliation campaign, filed the motion Friday before Judge Kaplan.  Lead attorney John Keker has called the New York proceedings orchestrated by Judge Kaplan a “show trial” and previously said that Kaplan was treating him “like a goat tethered to a stake.”

Separately, and for similar reasons, the Houston-based law firm Smyser Kaplan & Veselka also announced it would seek to withdraw from the case on behalf of the two Ecuadorian rainforest residents who have appeared, Javier Piaguaje and Hugo Camacho.

Steven Miller is breaking his silence about the scandal that’s engulfing the Internal Revenue Service.

Miller, the acting IRS commissioner, is quickly emerging as the focus of fury in Washington after an agency official acknowledged last week that conservative groups seeking nonprofit status were targeted for extra screening if their applications included words such as “tea party” or “patriot.”

University to Bestow Lois Lerner —‘Face of IRS Scandal’ — with Honorary Tribute

The woman in charge of the IRS division responsible for reviewing tax-exempt status applications and who is at the heart of an ongoing scandal over revelations the agency targeted conservative groups is set to receive an honorary tribute from Western New England University School of Law on Saturday.

Lois Lerner – director for the IRS Exempt Organization Division – is slated to deliver the school’s commencement address and be given the university’s “President’s Medallion.”

Established in 2002, the award is “bestowed upon those who have distinguished themselves in a particular field or in service to an important cause that has benefited society locally, regionally, nationally, or internationally,” the college’s website states.

In the wake of revelations that her division zeroed in on and gave extra scrutiny to groups with “tea party” or “patriot” in their names, Lerner, 62, has been thrust into the national spotlight, dubbed by some as the “face of the IRS scandal.”

Lerner knew of the inappropriate focus in her division on conservative groups since June 2011. She recently apologized publicly, but won’t comment on whether IRS employees will be disciplined, and denied any political bias was involved in the effort.

In touting Lerner’s impending arrival to the Springfield, Mass., campus – her alma mater – university officials noted she graduated from the law school in 1978 and now oversees nearly 1,000 employees charged with reviewing IRS applications for tax-exempt status and conducting examinations and compliance efforts.

Campus officials also tout how she is past president of the Council on Governmental Ethics Laws.

More recently, she has become the butt of jokes on social media and news websites after she revealed during a conference call with reporters Friday that “I’m not good at math.”

“You’re with the IRS, thank you,” replied Tom Costello of NBC News with a chuckle. He had asked the question that prompted her admission.

“I am a lawyer, I am not an accountant,” Lerner had quickly replied.

Important Message from Judge Steve White (President, The Alliance of California Judges) Re Judiciary Budget

I am sending you this important message regarding the 2013-2014 Judiciary budget. We anticipate the release of the Governor’s May Revise next week. Alliance members have been engaged in quiet discussion with members and staff of the Legislature and with some within the Executive branch. There has been meaningful concern expressed within the Legislature that the budget cuts to the courts have resulted in a serious erosion of public access to justice. Some restoration of funding is being considered. We anticipate that the Speaker of the Assembly may soon announce the primary budget goals of the Assembly and are optimistic that these will include a proposal for additional trial court funding. We expect the proposal to be coupled with strict demands for transparency and accountability, and a direction that 100% of the money be directed to the trial courts.

In April the Director of the AOC, Steven Jahr, released a statement that clarified action by the Assembly Budget Subcommittee on April 5, 2013. Director Jahr correctly pointed out that the Subcommittee had simply confirmed the Governor’s proposed budget, which continues a permanent, ongoing cut of $535 million to the branch, requiring the trial courts to absorb an additional $261 million in cuts by the end of this fiscal year.

Director Jahr’s communication also confirmed that the AOC’s proposed funding solutions this year include a request for a full restoration of funding including:

  • $475 million restored from the General Fund
  • $18.5 million to fund appellate court costs
  • $49.3 million for employee health care and retirement cost increases
  • Elimination of the 1% trial court reserve balance limitation

The Alliance supports these goals, and the efforts of the Chief Justice in pursuing them.  We also recognize there must be buy-in of the Legislative and Executive branches.  Having these considerations very much in mind, we have not made any specific budget proposals while awaiting the Governor’s May Revise and the stated positions of the two legislative houses. After the May revise, and especially if, as we expect, it does not propose additional trial court funding, we plan to offer meaningful options for restoring branch funding.

Throughout the state, our courtrooms are shutting down. We are no longer able to provide essential services to our communities, the people who elect us to serve justice. At least 200 courtrooms have closed and 2500 court workers have lost their jobs. For the first time in our history, our core ethic — the adjudication of cases and controversies — is threatened. This did not happen even in the Great Depression.

This cannot abide. The priorities of this branch must be revisited.

I would like to close with a laudatory reference to the important action taken by Judge Laurie Earl’s subcommittee of the Trial Court Working Group.  The committee proposed a new allocation model for funding the trial courts, which has now been “adopted” by the Judicial Council. We understand and agree with the effort to recast the existing historic funding model that may perpetuate inequities. However, trial court funding is a function of the Legislature. It is a creature of statute, not a constitutional function of the Judicial Council. This change was not mandated by the Legislature or the Department of Finance. Such an important change requires a fuller and more inclusive vetting and more input than occurred in the closed committee process.  Just as in the federal courts and the other state courts, the Legislative and Executive branches also play an important role in this.  Judges should not presume that we can make such significant changes without the buy-in of our sister branches.  This is as it should be.  Even for those who wish it were otherwise, the three branches of government are necessarily part of the decision.
